What Is a TCPA Litigator — and Why One Call Can Cost $500 to $1,500

The Telephone Consumer Protection Act (TCPA) was written in 1991 to stop unwanted telemarketing. Three decades later it is one of the most litigated consumer statutes in the United States — and a small group of repeat plaintiffs files a large share of those cases.
Who TCPA litigators are
A "TCPA litigator" is a person who files, or threatens to file, TCPA claims repeatedly. Some are consumers who receive many unwanted calls. Others deliberately keep phone numbers active, register them on Do Not Call lists and wait for calls to arrive. Many work with attorneys who specialize in consumer protection cases.
What they share is a business model: every qualifying call or text can become a claim, and claims are often settled before trial because defending them is expensive.
What the statute allows
The TCPA sets statutory damages, which means a plaintiff does not have to prove actual harm:
- $500 per violating call or text.
- Up to $1,500 per call or text if a court finds the violation was willful or knowing.
- Each call counts separately, so ten calls to one number can be ten violations.
- Class actions multiply the exposure across every number in a list.
A single campaign that reaches the wrong numbers a few dozen times can quickly create a five- or six-figure demand letter.
Common claims
Most demand letters and complaints point to one or more of these issues:
- Calling or texting a number on the National Do Not Call Registry without an exemption.
- Using an autodialer or prerecorded voice on a mobile number without proper prior express consent.
- Calling outside permitted hours in the recipient's time zone.
- Calling a number that was reassigned to someone who never gave consent.
- Continuing to call after the person asked you to stop.
Why screening before you dial matters
You can't control who files a lawsuit, but you can control which numbers your team and your dialers reach. Screening a list before a campaign gives you a chance to review risky numbers before they turn into calls:
- Numbers associated with known litigators or complaint activity can be flagged for review or suppression.
- Line type (mobile, landline, VoIP) tells you which consent rules apply.
- The number's region gives you an estimated time zone for calling windows.
- Fake or dummy numbers reveal lead sources that may also be weak on consent.
TCPA Firewall screens each number against the lists enabled on your account and returns carrier, line type and region in the same lookup. A flag is a reason to look closer — not a legal conclusion — and a clean result is not proof of consent.
The bottom line
TCPA litigation is a numbers game, and it rewards the plaintiff for every call that reaches them. The cheapest protection is to know who is on your list before the first dial, keep records of your screening and consent, and remove the numbers you are not comfortable calling.
